1. Introduction

Welcome to the Blairgowrie Public Pool fundraising website, operated by the Blairgowrie Community Association, referred to in these terms as “the BCA”, “we”, “us” or “our”.

This website provides information about the Blairgowrie Public Pool maintenance and upgrade project and allows members of the public to make voluntary financial contributions toward the project.

By accessing this website or making a donation, you agree to these Terms and Conditions.

3. Purpose of the fundraising campaign

The fundraising campaign supports the ongoing maintenance, repairs and upgrades associated with Blairgowrie Public Pool.

Funds may be applied to project requirements including:

  • pool lining, sealing and remedial work;
  • bathroom and facility improvements;
  • paving, access and security improvements;
  • plumbing, valves and water-management work;
  • landscaping, maintenance and related site improvements;
  • professional, contractor, payment-processing and administrative costs reasonably associated with the project.

The scope, sequence and timing of individual tasks may change depending on quotations, available funds, warranty work, contractor availability and operational priorities.

4. Nature of donations

All payments made through this website are voluntary donations to the pool project.

A donation does not:

  • purchase ownership, membership or decision-making rights;
  • create an investment or financial return;
  • guarantee that a particular task will be completed by a particular date;
  • entitle the donor to goods or services unless this is expressly stated;
  • create a contractual right to direct how the BCA applies the donation.

Where a donor selects a suggested amount or enters a custom amount, the amount confirmed during checkout will be treated as the intended donation amount.

5. Use of funds

The BCA intends to use donations for the Blairgowrie Public Pool project and closely related project costs.

Where circumstances change, the BCA may reasonably reallocate funds between project tasks based on urgency, technical advice, quotations, warranties, available funding and the overall interests of the pool project.

If more funds are raised than are required for a particular listed task, the remaining funds may be applied to other maintenance, improvement or operational requirements associated with Blairgowrie Public Pool, unless the BCA has expressly stated otherwise.

6. Payment processing

Online payments are processed through third-party payment providers, including PayFast.

The BCA does not directly process or store complete payment-card information on this website. Payment information is submitted to and processed by the relevant payment provider in accordance with its own terms and privacy practices. PayFast states that its payment environment is PCI DSS Level 1 compliant.

A donation is only regarded as successfully received once the payment provider confirms the transaction.

7. Receipts and tax treatment

An electronic payment or order confirmation may be sent after a successful donation.

Unless the BCA expressly confirms otherwise in writing, the confirmation is a payment acknowledgement and not necessarily a tax-deductible donation certificate.

Donors are responsible for obtaining their own tax advice regarding the deductibility of any donation.

8. Accuracy of information

We aim to keep the website’s project information, fundraising amounts, task descriptions and progress updates reasonably accurate.

However:

  • project costs may change after quotations or inspections;
  • estimated targets may be revised;
  • task descriptions may be updated;
  • project dates may change;
  • amounts displayed as raised may not update immediately after each payment.

Website content is provided for general information and project transparency and should not be interpreted as a binding technical, financial or completion guarantee.

9. Website availability

We do not guarantee that the website or payment facility will always be available, uninterrupted or error-free.

We may temporarily suspend or change the website for maintenance, security, technical or operational reasons.

10. Acceptable use

You may not use the website:

  • for unlawful, fraudulent or abusive purposes;
  • to interfere with its operation or security;
  • to introduce malicious code;
  • to attempt unauthorised access to the website, database or payment systems;
  • to submit false payment, identity or contact information;
  • to copy or exploit the website’s content for misleading or unauthorised purposes.

11. Intellectual property

Unless otherwise stated, the website design, written content, project graphics, photographs, logos and other material are owned by or used with the permission of the BCA.

You may share official fundraising graphics and links for the purpose of supporting and promoting the project.

You may not alter the BCA logo, misrepresent the fundraising campaign or suggest that the BCA endorses another organisation without written permission.

12. Third-party services and links

The website may contain links to third-party websites and services, including payment providers and social-media platforms.

Those services are controlled by their respective operators. The BCA is not responsible for their availability, content, privacy practices or separate terms.

13. Limitation of liability

To the fullest extent permitted by South African law, the BCA, its committee members, volunteers and service providers will not be liable for indirect, incidental or consequential losses arising from:

  • the use or inability to use the website;
  • temporary website or payment interruptions;
  • reliance on project estimates or anticipated completion dates;
  • third-party payment, hosting or communications services;
  • unauthorised access caused by circumstances beyond our reasonable control.

Nothing in these terms excludes liability that cannot lawfully be excluded.

14. Changes to these terms

We may update these Terms and Conditions when the website, fundraising campaign, payment process or legal requirements change.

The updated version will be published on this page with a revised “last updated” date.

15. Governing law

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any dispute will be subject to the jurisdiction of the competent South African courts.
